Terms & conditions
These terms apply to every order you place on btcclothing.shop. Please read them before you order. They don’t affect your legal rights as a consumer.
1. Who we are
BTC is a trading name of MICHAEL HARRIS JR, an individual trading as a sole proprietor based in Laurel, Mississippi, United States. In these terms, “we”, “us” and “our” mean MICHAEL HARRIS JR trading as BTC.
Postal address: 520 Harvest Quarters, Laurel, MS 39440, United States
Email: mikenike78@tutamail.com
2. Who these terms are for
We sell to consumers in the United Kingdom who are buying for their own personal use. If you are buying for a business, section 11 explains how our responsibility to you is different.
3. How the contract is formed
When you place an order you’ll receive an email confirming we’ve received it. This isn’t acceptance. Our acceptance takes place when we email you to say your order has been dispatched, and that is when a contract between you and us is formed.
We may not accept your order if an item is out of stock, if we can’t verify your payment, if there’s been an obvious pricing error, or if we can’t deliver to your address. If so, we’ll tell you and won’t charge you, or we’ll refund anything you’ve paid in full.
The contract is in English.
4. Our products
Our pieces are made in limited runs. We do our best to show colours and details accurately, but your screen may display them slightly differently and handmade or washed finishes vary a little from piece to piece. Each product page lists the available sizes.
5. Prices and payment
Prices are shown in pounds sterling (GBP). Prices include VAT at the current UK rate. The delivery charge is shown at checkout before you pay.
Our prices include any UK import VAT and customs duty. You won’t pay anything extra on delivery.
We take payment when you place your order. Payments are processed securely by our payment provider; we never see or store your full card details.
If we discover we’ve shown an obviously wrong price, we’ll contact you before dispatch so you can choose to pay the correct price or cancel for a full refund.
6. Delivery
We deliver to addresses in the United Kingdom. Delivery costs and times are set out on our delivery page. Orders are dispatched from United Kingdom.
The items are your responsibility from the time they’re delivered to the address you gave us. You own the items once we’ve received payment in full.
If delivery is delayed by an event outside our control, we’ll contact you as soon as possible and take steps to minimise the delay. If the delay is likely to be substantial, you can contact us to end the contract and receive a refund for anything you’ve paid but not received.
7. Your right to cancel (14 days)
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you can change your mind and cancel your order within 14 days, starting the day after you receive the items. If your order arrives in separate deliveries, the 14 days start the day after the last item arrives.
To cancel, tell us clearly by emailing mikenike78@tutamail.com with your name, address, order number and the items you’re cancelling. You can use the model cancellation form at the end of these terms, but you don’t have to.
You must send the items back within 14 days of telling us you want to cancel. You pay the cost of returning them, unless they’re faulty or not as described.
We’ll refund the price you paid for the items and the standard delivery charge within 14 days of receiving the items back, or of you providing proof that you’ve sent them, whichever is sooner. We’ll use the same payment method you used. If you chose a more expensive delivery option, we only refund the cost of standard delivery.
You may handle the items as you would in a shop to check them. If they’ve been worn, washed or damaged, or the tags removed, we may reduce your refund to reflect the loss in value.
8. Our longer returns window
As well as your legal right to cancel, we accept returns of unworn items with tags attached for 30 days from delivery. Details are on our returns page. This is in addition to your legal rights, not instead of them.
9. If something is wrong with your order
We are under a legal duty to supply goods that are of satisfactory quality, fit for purpose and as described. Under the Consumer Rights Act 2015, in summary:
- within 30 days of delivery you can reject faulty goods and get a full refund;
- within six months of delivery, if a fault appears, you’re entitled to a repair or replacement, and if that fails or isn’t possible, a refund in most cases;
- after six months you may still be entitled to a repair, replacement or refund, but you may need to show the fault was there when you received the goods.
If an item is faulty, email mikenike78@tutamail.com with your order number and a photo. We cover the cost of returning faulty items. Normal wear and tear, misuse or not following the care label are not faults. For more detail, visit Citizens Advice at citizensadvice.org.uk.
10. Our responsibility for loss or damage
If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable.
We do not exclude or limit our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for breach of your legal rights in relation to the products, including the right to receive products that are as described and of satisfactory quality.
We only supply products for domestic and private use. We have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.
11. Business customers
If you are buying as a business, the right to cancel in section 7 doesn’t apply, and our total liability to you in connection with an order is limited to the price you paid for it. Nothing in this section limits liability that cannot be limited by law.
12. Events outside our control
We are not responsible for delays or failures caused by events outside our reasonable control, such as carrier disruption, extreme weather, strikes or system failures. We’ll tell you as soon as possible and do what we can to reduce the effect.
13. Your personal information
We use your personal information as described in our privacy policy.
14. Other important terms
We may transfer our rights and obligations under these terms to someone else; we’ll tell you if this happens and make sure it won’t affect your rights. You need our consent to transfer your rights to someone else.
This contract is between you and us. No other person has any rights to enforce its terms under the Contracts (Rights of Third Parties) Act 1999.
If a court finds part of these terms unlawful, the rest will continue in force. If we don’t insist immediately that you do something you’re required to do, that doesn’t prevent us from taking steps against you later.
We may update these terms from time to time. The version that applies to your order is the one shown on this page when you placed it.
15. Complaints, law and courts
If you have a problem, email mikenike78@tutamail.com first. We aim to resolve complaints within 14 days.
These terms are governed by the law of England and Wales. You can bring legal proceedings in the courts of England and Wales. If you live in Scotland you can also bring proceedings in Scotland, and if you live in Northern Ireland you can also bring proceedings in Northern Ireland. Nothing in these terms takes away any protection you have under the law of the part of the UK where you live.
